Article 370, a breach to integrity

By invoking Article 370 drafted in Part XXI of the Indian Constitution : Temporary, Transitional and Special Provisions, Jammu and Kashmir is given special status to have a separate constitution, a state flag and autonomy over the internal administration of the State. The government of India revoked this special status on 5th August 2019 through a Presidential Order and the passage of a resolution in Parliament. Article describes that except for defence, foreign affairs, finance and communications, Parliament needs the state government’s concurrence for applying all other laws. Thus the state’s residents live under a separate set of laws, including those related to citizenship, ownership of property, and fundamental rights, as compared to other Indians. This indeed is a situation which rescinds the integrity of our country. Hence Government may revisit the Article and reframe accordingly.
